DHS drops legal case against state of New York.
The Department of Homeland Security announced late last week that New Yorkers would once again be allowed to enroll in trusted traveler security programs. The DHS had revoked New York residents’ ability to do so this past February due to the state’s policy of limiting police and public access to certain motor vehicle records, notably criminal history information.
While DHS released a statement that the law had been amended by the state legislature in April allowing increased access to applicants’ records, government attorneys wrote in a court filing that the information they had presented was inaccurate. They disclosed that several states in addition to New York prevent federal access to criminal history via motor vehicle records.
Legal proceedings were dropped and New Yorkers have been allowed back into the Trusted Traveler program “effective immediately.” Acting DHS Secretary Chad Wolf did caution that, “Local New York law continues to maintain provisions that undermine the security of the American people and purport to criminalize information sharing between law enforcement entities.”
